Terms of Service
These Terms govern your use of this website and any landing page operated by Traction Agency LLC (“Traction,” “we,” “us”) on behalf of a roofing contractor or related home-services client. By using the site, you agree to these terms.
If you are a paying client of Traction, your Master Services Agreement governs that relationship — not these consumer-facing Terms.
What Traction does
Traction provides marketing and customer-operations technology to its Clients. When you submit a form on this site, Traction routes your inquiry to the Client whose campaign you responded to, and may follow up by SMS, voice (including AI-generated voice), or email subject to the consent you provided. Traction does not itself perform roofing work; the Client does.
Consent to marketing communications
By submitting your phone number and checking the consent box, you provide express written consent under the TCPA for Traction and the Client to contact you at the number provided, including by automated text messages, automated phone calls, AI-generated voice calls, and prerecorded messages. Consent is not a condition of purchase. Message frequency varies. Standard carrier rates may apply.
Reply STOP to any text to opt out of SMS. Reply HELP for support. To opt out of voice or AI-voice calls, state your wish on the call or email privacy@tractionagency.com. See our Privacy Policy for details.
Acceptable use
You will not use the site for unlawful purposes, attempt to interfere with its security, scrape with automated systems (except per published robots.txt), submit information you did not have authorization to provide, or reverse-engineer Traction’s systems.
Intellectual property
The site, content, and underlying Traction platform are owned by Traction or licensed to Traction. You receive a limited, non-exclusive, non-transferable, revocable license to use the site for submitting an inquiry. You retain ownership of information you submit and grant Traction a non-exclusive license to use it for the purposes described in the Privacy Policy.
Disclaimers
The site and services are provided “as is” and “as available.” We disclaim all warranties express or implied to the maximum extent permitted by law. We don’t guarantee that any Client we route your inquiry to is the right contractor for your project; the Client is an independent business responsible for its own licensing, insurance, and work quality.
Limitation of liability
To the maximum extent permitted by law, our total cumulative liability arising from your use of the site is limited to one hundred U.S. dollars ($100). We are not liable for indirect, incidental, consequential, or punitive damages including lost profits or lost business. This limitation does not apply to liability that cannot be limited by law.
Governing law and disputes
These Terms are governed by the laws of the State of Traction’s formation (pending — to be confirmed at LLC formation). Disputes will be brought in the state and federal courts of that state. You agree to bring claims individually, not as part of a class action, where permitted by applicable law. Nothing in these Terms limits your statutory rights under the TCPA, state consumer-protection laws, or any other law that cannot be waived by contract.
Time limit for claims
Any claim arising from your use of the site must be brought within one (1) year after the cause of action accrues, unless applicable law requires a longer or non-shortenable period.
Changes to these terms
We may update these terms. Your continued use after the “Effective” date constitutes acceptance. We’ll provide additional notice for material changes affecting consumer-facing rights.
